“My Story” Wizard Additional Terms of Service

These terms constitute a legally binding agreement between you and Liska Művek Kft. By clicking the “I Accept” button or by using the “My Story” Wizard (the “Wizard”), you agree to be bound by its additional terms of service (the “Additional Terms”), the Wizard’s Terms of Use (available at https://www.firkamese.hu/sajatmese in the text marked with the same title, which may be updated from time to time), the relevant part of the Privacy Policy (available at https://firkamese.hu/adatkezelesi-tajekoztato/#at16, which may be updated from time to time), and all other applicable terms and conditions, including the content of the terms heretofore and hereafter.
The purpose of the “My Story” wizard is:
To convert a two-dimensional drawing uploaded to the (https://www.firkamese.hu/sajatmese) page into a moving image sequence (“animation”) based on the selected animation type (motion pattern). The process uses Meta AI… and … free (MLC) source code and technologies.
Information used to make the animated drawing demonstration work
As part of your use of the Demo and in accordance with the Meta Terms, you may choose to upload an image of your drawing (“Materials”) to the Demo as described above. Before the Demo creates an Animation, you will have the opportunity to correct the Demo’s identification, segmentation, and placement of joints on the hand-drawn characters (collectively, “Modifications”). After uploading or selecting the image and making the modifications (if any), the Demo will convert the image into an animation. Your uploaded materials will be deleted within 90 days. Animations created from Materials and Modifications are available to you through the Demo, subject to the terms and conditions described below.
Once you have created an animation from your drawing, you will have the option to download or share the generated animation on Facebook and certain other social media platforms. If you choose to share your created animation on social media, the privacy policies of the operator of the relevant social media platform(s) will apply to sharing your animation
Additional Terms
By using the Animated Drawings Demo, you represent, warrant and agree that: (a) you are at least 18 years of age (or the age of majority in the jurisdiction from which you access the Demo); (b) you are not a resident of Illinois or Texas, did not create any Materials in Illinois or Texas, and are not attempting to use the Demo from Illinois or Texas; (c) each piece of Materials submitted to the Demo is an original two-dimensional static drawing and does not contain or otherwise incorporate any other form of artwork or media (including photographs, videos, or music); (d) for each Material submitted to the Demo, you are the creator of that item; (e) you do not permit anyone under the age of 18 (or the age of majority in the jurisdiction from which you use the Demo) to use the Demo; and (f) the Materials do not contain any information that could be used to identify you or any other person (such as a name or any other personally identifiable information).
Subject to your compliance with the Meta Terms, Meta grants you a limited, non-exclusive, non-sublicensable, non-transferable right to (a) access and use the Demo, and (b) access the Animations made available through the Demo, solely for your non-commercial and personal use. You agree not to use or attempt to use the Animations outside of the Demo or in any manner other than as expressly permitted herein. Meta and its licensors reserve all rights in and to the Demo and the Animations not expressly granted herein. In the event that Meta removes an Animation from the Demo, your right to access the Animation will terminate. Meta may revoke this right from you at any time and for any reason in its sole discretion.
You grant Meta and its affiliates, licensors and agents a perpetual, irrevocable, non-exclusive, royalty-free license to reproduce, distribute, perform and display (publicly or otherwise), modify, create derivative works from, store and otherwise exploit the materials, animations and modifications associated with the Demo.
As a large company, Meta takes infringement of intellectual property very seriously. You may not submit content to the Demo that infringes on the intellectual property rights of others (e.g., please do not make drawings of Mickey Mouse). Do not upload content that could be considered offensive.
Because Meta does not associate Materials or Animations (including Modifications) with your name or any other personally identifiable information, you may not request the deletion of any Submissions or Animations created from such Materials. You represent and warrant that you will not submit any sensitive personal information to the Demo, including, but not limited to, information about an identifiable individual’s ethnic or racial origin, religious beliefs, health status, or sexual orientation. Please ensure that you have read and understood the Meta Terms before submitting any materials, generating animations, or otherwise using the Demo.
The Demo allows you to share Animations generated from your Submissions, including modifications to such Animations, on Facebook and certain other social media platforms. If you choose to share your Animation on any such social media platform, your use of the Animation will be subject to the additional terms and policies applicable to such platforms.
In connection with your use of the Demo, you may provide feedback on the accuracy of the resulting Animations (“Feedback”). Because your Feedback is not associated with your name or other personally identifiable information, you cannot request access to or deletion of Feedback you submit.
You grant Meta and its affiliates, and their respective agents and assigns, a perpetual, irrevocable, non-exclusive, sublicensable (through multiple tiers), transferable, and royalty-free license to reproduce, store, distribute, perform and display (publicly or otherwise), modify, create derivative works from, and otherwise exploit (collectively, “Use”) the Feedback, including for the development of the Demo and/or related AI or software program(s), for research purposes, and for Meta’s internal business purposes. Meta is not obligated to use the Feedback you provide or compensate Meta for any Feedback used by Meta.
The Demo is controlled or operated (or both) from the United States and is not intended to subject Meta to any jurisdiction outside the United States. jurisdiction or law (or if you are accessing from the EU/EEA, the controller responsible for your data is Meta Platforms Ireland Limited).
These Additional Terms are effective until terminated by Meta. Meta reserves the right to terminate your right to access and use the Demo and your right to access the Animations for any reason, including, but not limited to, if you breach these Additional Terms or the Meta Terms. Meta may also terminate these Additional Terms and/or terminate the Demo for any reason. Paragraphs 3-18 will survive any termination of these Additional Terms.
The Demo and the Animations made available through the Demo are for entertainment purposes only. Meta makes no representations or warranties as to the adequacy, accuracy, timeliness or completeness of the Demo, the Animations or any other information or content made available through the Demo. You use the Demo at your own risk. The Demo and the Animations made available through the Demo are provided “AS IS” without any express or implied representations or warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or other violation of rights. Meta expressly disclaims any liability for errors or omissions in the Demo or the Animations. Some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
In no event shall Meta or its affiliates, or their respective directors, officers, employees, licensors, agents and assigns, be liable for any indirect, special, incidental, consequential or punitive damages, lost profits or other indirect damages arising out of or in connection with the use of the Demo, even if one or more of them has been advised of the possibility of such damages or losses. Without limiting the foregoing, the maximum aggregate liability of Meta or its affiliates, or their respective directors, officers, employees, licensors, agents and assigns for all damages, losses and causes of action, whether in contract, tort (including negligence) or otherwise, arising out of or in connection with the use of the Demo shall be fifty dollars ($50). 3,103 / 5,000
Consistent with your representation, warranty, and agreement in subsection (b) of Section 2 above, you hereby expressly waive any claim that you or your representative may have against Meta or any Meta Affiliate that alleges that these Additional Terms or the conduct described herein does not comply with or otherwise violates the Illinois Biometric Data Privacy Act, 740 ILCS 14, or the Texas Biometric Identifier Recording or Use Act, Tex. Bus. & Com. Code § 503. You further waive and release any claim that you or your representative may have against Meta or any Meta Affiliate arising out of or related to your use of the Demo or these Additional Terms under any of the aforementioned laws. If any aspect of this paragraph is held invalid or unenforceable, that aspect shall be severed and shall not affect the validity or enforceability of any other aspect.
In the event of any claim, cause of action or dispute arising out of or relating to these Additional Terms or the Demo, you agree that it shall be resolved exclusively in the United States District Court for the Northern District of California or a state court located in San Mateo County. You also agree to submit to the personal jurisdiction of any such court for the purpose of litigating such Claims, and that these Additional Terms and any Claim shall be governed by the laws of the State of California, without regard to its conflict of laws rules, including to the extent that enforcement of an agreed choice of law would result in the termination of a cause of action that you would otherwise have under the laws of another jurisdiction.
Any delay or failure to enforce any provision of these Additional Terms shall not constitute a waiver of our right to enforce them at a later date.
If any provision of these Additional Terms is held to be invalid or unenforceable, that provision shall be severed and shall not affect the validity or enforceability of any other provision.
In the event of any conflict between these Additional Terms and the Meta Terms, these Additional Terms shall govern solely with respect to your use of the Demo and solely to the extent of the conflict.
We may revise and update these Additional Terms from time to time in our sole discretion, so we encourage you to check back regularly for updates. If you continue to access or use the Demo after we post updated Additional Terms on our website or otherwise notify you of changes to the Additional Terms, you agree to be bound by the updated Additional Terms. If you do not agree to the updated Additional Terms, you must stop using the Demo.
